AP Accuses Obama Artist Of Copyright Infringement

Here’s a story that doesn’t surprise me
The pensive Obama facing upward, forward, onward and futureward, with that Warholesque red, white and blue and the word, HOPE, is the work of Shepard Fairey, a Los-Angeles based street artist.

It has driven the sales of hundreds of thousands of posters and stickers, with Fairey-signed copies fetching thousands of dollars on eBay.

It is based, Fairey has acknowledged, on an Associated Press photograph, taken in April 2006 by Manny Garcia at the National Press Club in Washington.

The AP is asking for credit — and compensation.

They only noticed it when it got known. I think acknowledgment is already enough. The design of the revised picture is great however,shepard should have asked permission to avoid conflicts.

I just came across a website. The theme is “be a part of American Internet history”. It allows individuals to post some comments for $1.50 per block. I will be checking in to see how it goes. I think it’s a pretty good idea. Check it out.

Looks like a great photo, but it was indeed taken from the work of AP.. A sticky situation…. If there is profit in the direct sale of the photo, they may have some rights to it.

Sheperd Fairey should just settle out of court. It’s basically sampling someone else’s work. AP should let him pay the original license fee and Fairey should pay AP a small percentage of what he’s earned from this work.
Fairey has no fair use arguement here because he’s using another person’s work, regardless of his intent. It’s like saying I like the car you just bought, so I’m gonna take it eventhough you paid for it.
