Crowd-sourcing for the Shepard Fairey vs AP case

Shephard Fairey vs AP for Obama image

As you might have heard, after Shepard Fairey was sued by AP for unauthorized use of the Obama photo, Shepard Fairey decided to counter-sue AP using the “fair use” defense.

As a member of Fairey’s defense team, Lawrence Lessig has an update on Shepard Fairey’s case, asking the public for similar images of Obama on his blog:

As mentioned, the Fair Use Project at Stanford’s CIS is representing Shepard Fairey in his suit against the AP. To that end, we’d be grateful for some net-based knowledge. How many photos are there “like” the beautiful photograph that Mannie Garcia took (the one on the left; the one on the right is a CC licensed photo taken by Steve Jurvetson)? Can you send any examples to shep_use@pobox.com?

Also, please send any favorite examples of photos used as visual references for other works of art. We lawyers don’t know much, but we can learn pretty quickly.

    Actually, it was Fairey who filed the first legal papers. It is the AP who is counter-suing. FYI.

    this case has been quite taking time just because of President Obama’s photo. He is a very important person because he is the president. People are arguing about it because you can earn big with it.

    I think people should be critical of Shep Fairey. I like the response this guy made to Sheps AP response. I agree with him that if Obey Giant Art Inc. wins its case again the AP it will open the doors for other companies that want to use photographers or any other art images. People need to stop painting this case out as being just a big mean media source vs. a little artist. The case involves Fairey AND Obey Giant Art Inc.! A company! And Fairey is by no means a poor artist even before the Obama poster. And it is very true that Huffington Post is not posting comments that point out these facts! Read the truth here,
